TERMS AND CONDITIONS
VAMARES is brand operated by White Village, LLC, a corporation established legally as a wholesale travel concierge and marketer of tourism services provided by various national and foreign suppliers.
Our company liability is limited to establishing the contract between the purchaser and the service providers so that services are purchased by our customers in a timely manner, in the quantity, quality and price requested, specified and paid by the purchaser and previously accepted by VAMARES in accordance with the terms and conditions of sale set out in this document.
VAMARES is not responsible for any claim arising from losses, diseases, damages, delays, non-use of services and discomfort due to:
- Failure, negligence or omission by service providers
- Diseases, theft, strikes, breakage of luggage, quarantine, Government restrictions, weather conditions or other reasons beyond our control
- Failure, neglect, or failure by the passenger in connection with the required travel documentation
- Failure of passengers to check in at the hours required at airports for departures or returns, whatever the reason for any delay
- Flight delay or cancellation of services in any type of transportation caused by the service provider
- Material damage, loss of property or theft
- Personal injury and accidents, whatever their cause
- Lost or damaged passports
- Visas denied or cancelled by the authorities of the destination country
- Breach by the passenger of any laws of the destination country, as well as violations of sanitary and customs regulations
Passports and Visas:
Participants must have a passport that is valid for at least six (6) months after the program return date. Holders of passports issued by foreign countries, green card (USA), U.S. visa, or special use passport, will be responsible for the limitations imposed by said document with respect to re-entry into the U.S. VAMARES will not be held responsible for services denied to a participant by a carrier or entry denied by any country due to a restricted visa or the denial of a visa by the particular government. In the event that a participant is denied entry to a particular country due to passport or visa problems, the cancellation policy will apply.
Each participant is responsible for valid documentation in order to enter any country, as well as for returning to the U.S. or traveling through a third country to certain countries, if applicable.
To make reservations we require that passengers provide us with their surname and the first name as they appear in their passport and/or other travel documents. Any error is the passenger’s responsibility.
Program Prices:
Programs are priced including only the services described therein. Charges for transfers or land transportation are subject to change without previous notification.
Booking and Payment:
Participant agrees to pay the applicable program price as quoted at the time of booking. A non-refundable $200.00 deposit will be required to book and hold the reservation. One hundred percent (100%) of the program price will be payable 45 days prior to the date of departure. In the event that full payment is not received 45 days prior to the departure date, the reservation may be cancelled.
Flights
At present, charters flights from the United States are highly regulated by the U.S. Department of the Treasury and the U.S. Department of Transportation. Only licensed travelers authorized by the U.S. Department of the Treasury’s Office of Foreign Assets Control are able to secure a seat on direct charter flights.
VAMARES will book your international flight from the U.S. using a licensed charter company authorized to provide direct flights.
Once booked on one of our programs, we will secure your seat on one of the charter flights to Cuba and prepare your flight package including the following:
- Round-trip charter airfare from the U.S. to Cuba
- All government taxes, fees and charges imposed upon licensed travelers and carriers-imposed fees (such as fuel charges)
- Medical insurance
Flights are only confirmed after full payment has been received. Most tickets are not refundable and non-transferable (valid only for the passenger whose name appears on the ticket). Changes or modifications will result in additional charges. Some charter companies offer First or Business class seats, depending on the configuration of their aircraft. In such cases, booking premium seats is possible, based on the applicable fair.
Besides airline cancellation and no-show policy, an administrative fee of up to $50.00 USD (or equivalent in local currency) will apply to all cancellations and modifications to your reservation. We aim to process refunds within 72 hours after receiving your refund request and required information. However, for flights booked on our systems through connectivity to Global Distribution Systems (e.g. Sabre), after tickets are issued refunds can take up to 4 (four) weeks from the date of cancellation, as payments and reimbursements to/from the airline are processed through IATA’s Billing & Settlement Plan (BSP).
REFUNDS: We will not make refunds to credit cards other than the credit card that was used for your booking. We may process refunds via wire transfer, in which case we will deduct any bank charges from the refundable amount.
CHILDREN POLICY
Infant rates apply for ages up to 2 years
Children rates apply for ages between 3 and 11 years
Children 12 years and older must be booked as adults
FARES: Please note that fares are not guaranteed until payment is made and accepted by VAMARES. Displayed prices are subject to change but will be confirmed when your booking is completed. For flights booked by our systems through connectivity to airline systems via global distribution systems (e.g. Sabre), flight fares and/or taxes will be reconfirmed when e-tickets are issued – in rare occasions an increase of fares and/or taxes may occur, which will be notified to you for acceptance of the new price. You have the right not to accept such a price increase, with a full refund from VAMARES. Besides flight prices and taxes, booking fees and/or surcharges may apply. All such charges will be shown during the reservation process.
TAXES: In some cases, departure taxes are payable to the government in the country of departure and are non-refundable.
TICKETS: Within the next business day (Mon – Fri, 9 am – 6 pm, GMT -05.00) of your booking, you will receive an electronic ticket or supplier confirmation document, which must be printed out and taken to airport check-in on the day of departure, along with the appropriate travel documents.
FLIGHT TIMES / RECONFIRMATION: Flight times are subject to change by the airline, due to operational problems or weather conditions. You must reconfirm your flights with VAMARES within 48 hours prior to your departure. Also, you need to make sure that our staff on the telephone number or e-mail address provided by you during the reservation process, in order to inform you about possible flight schedule changes, can reach you.
AIRLINE AND CHARTERS RULES & RESTRICTIONS: When you purchase your ticket, you agree to specific airline rules and/or restrictions that apply to your selected flight/fare. You must check these rules and/or restrictions during the reservation process, before online payment.
Rules and restrictions are imposed by the airlines and are subject to change.
Cancellation and Refund of Land Programs:
VAMARES reserves the right to refuse a participant, at any time prior to departure, or to cancel the program in which a participant is registered to participate. In the event of such cancellation, or if the participant is denied entrance in any particular country, the total amount payable (less the airfare) will be refunded, unless the cancellation is due to non-payment of the price of the program or due to governmental action beyond the control of VAMARES, such refund will reflect the administrative expenses involved in the organization of the program. Aside from such refund, VAMARES will not be held responsible for any other refund, costs, interest, responsibility or damages.
If the participant cancels for any reason, VAMARES must be notified in writing. Such cancellation will be effective from the moment of receipt of such notification in writing. In this case, the refund will be made as follows:
The $200.00 deposit is not refundable. This deposit may be applied to other available programs within a term of 365 days and subject to space and availability.
For cancellations made 45 days or more prior to departure date, 100% of the rate and air costs of the program will be refunded.
From 45 to 30 days prior to the date of departure, 50% will be refunded (not including deposit and applicable fees). From 30 days or less from departure date, there will not be any refund.
There will be no partial refunds for unused portions of the program.
Rates
Our rates are per person and are expressed in US dollars.
Payment of taxes and charges
Foreign taxes and fees (such as airport tax, or mandatory gratuities, etc.) are generally not included in the price of the program.
Delivery of documents
Most travel documents will be delivered electronically, in working days and hours.
Accommodation services
Hotel check-in time is variable and may depend on the level of occupancy of the facility at the time of arrival. The usual check-in time is 15:00. Check-out must be before 12:00 noon.
Standards of quality and services of the contracted hotels may differ from those of the country of origin of each client.
Services not rendered
In the case that the passenger might not receive a service that has been booked and prepaid with us, for reasons not attributable to the customer, he or she must submit a refund request in writing within three working days after the date of return to their country, attaching documents (for example: evidence of the lack of services, proof of payment) to support your complaint. Our Customer Service department will review and verify your complaint, and where appropriate, we will refund customer the appropriate amount. We do not accept any other additional liability, as indicated in this document.
Program Changes
VAMARES puts a lot of effort in developing and operating the programs as they are described. However, circumstances beyond our control may require adjustments of the program plan. We try hard to avoid such changes but we reserve the right to make the necessary modifications. These may include changes in accommodations. If a participant cancels a program because of changes of this nature, the standard cancellation policy will apply.
